"City Shots" Photo Contest

Amateur photographers from the Tri-Cities and the surrounding area are invited to submit images for an on-line competition which will be determined by site visitor votes. The grand prize winner will be awarded a standard photo session with the contest sponsor, IrisCandy Digital Photography of Bay City, Michigan.

Photographers are asked to submit images that best capture the essence of their city.

Eligibility

• Contestants must affirm that submissions are their original work and that they are the holder of the copyright or that they have the right to copyright any and all photos submitted to this contest. Affirmation is considered confirmed with an entrant's photo submission.
• All photos must be city-related.
• All photos must be submitted as digital files and saved as a high-quality JPEG.
• Photo submissions must be identifed with ENTRANT'S NAME AND DESTINATION in the format firstinitialsurname-destination.jpg (eg: jsmith-baycity.jpg). Any image left unnamed or mislabeled will be disqualified.
• Photo submissions begin July 1, 2008 and has been extended until September 30, 2008.
• Registrants are only allowed to submit one photo per IP address. Multiple submissions and/or registration will result in disqualification from the contest.
• Only amateur photos will be accepted.
• All photos will be reviewed by TriCityLocal.com before acceptance into the contest. TriCityLocal.com reserves the right to refuse acceptance for whatever reason.

Personal information collected by TriCityLocal.com will be used solely for the purpose of verifying eligibility and to contact and/or publish information about contest winners, or to promote future contests on TriCityLocal.com.

All photos submitted remain the copyright of the registrant. Submitted photos, with the exception of the contest winner, will be deleted after completion of the contest. No personal information will be provided to any other company or third-party.

Judging and Voting

Judging and Voting will begin October 1. All accepted photos will be viewable and voted on by visitors to TriCityLocal.com. Visitors will be able to vote on multiple photos, but only once per photo. In the event of a tie, TriCityLocal.com staff will determine the winner. Voting ends October 31, 2008.

Prizes

Prize winnings cannot be combined with any other offer. Prizes are valid until October 1, 2009. No purchase is necessary to enter this contest. TriCityLocal.com reserves the right to provide a prize substitution in the event a contest sponsor terminates their sponsorship during an active contest.

Usage Rights and Indemnity

By entering, each entrant warrants and represents in connection with the photograph submitted as part of his/her entry that: (a) he/she is the owner; (b) that it is an original; (c) he/she has all necessary rights, including model releases, to grant the rights set forth below; (d) it has not been previously published or submitted in any other contests or competitions and/or to any media, including, without limitation, any advertisements, books, magazines, postcards, or calendars; (e) it does not defame or otherwise violate the rights of any third party; and (f) it does not violate any federal, state, or local laws, or ordinances.

Winners agree that TriCityLocal.com and its designees shall have the perpetual, worldwide right to edit, publish, and use any photograph entered in this Contest solely for the promotional purposes of TriCityLocal.com and/or the contest, in any way and in any media, at its sole discretion without further consideration to entrant or winner. Entrant agrees to hold harmless TriCityLocal.com and its parent company, Bay Imaging and Technology Services, LLC along with its contest sponsor, its officers, directors, employees, divisions, affiliates, subsidiaries, advertising and promotional agencies, from any claim by any third party relating to any rights in any photograph submitted.

ENTRANT AGREES TO DEFEND OR AT ITS OPTION SETTLE ANY CLAIM OR ACTION BROUGHT AGAINST TRICITYLOCAL.COM AND/OR ITS PARENT COMPANY, BAY IMAGING AND TECHNOLOGY SERVICES, LLC  AND/OR ITS SPONSOR, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS AND AFFILIATES (COLLECTIVELY, THE “INDEMNITEES”) ARISING OUT OF OR RELATING TO AN ALLEGATION THAT: (I) ANY PHOTOGRAPH PROVIDED TO TRICITYLOCAL.COM HEREUNDER THAT INFRINGES OR MISAPPROPRIATES, OR ALLEGEDLY INFRINGE OR MISAPPROPRIATES, THE INTELLECTUAL PROPERTY RIGHTS OF A THIRD PARTY, OR (II) ANY PHOTOGRAPH PROVIDED TO TRICITYLOCAL.COM DEFAMES OR OTHERWISE VIOLATES ANY PRIVACY OR OTHER RIGHTS OF A THIRD PARTY; AND ENTRANT WILL INDEMNIFY INDEMNITEES AGAINST ANY AND ALL LOSSES, DAMAGES, SUITS, JUDGMENTS, COSTS AND EXPENSES (INCLUDING LITIGATION COSTS AND REASONABLE ATTORNEYS' FEES) ARISING UNDER ANY SUCH CLAIM OR ACTION.

ADDITIONAL RULES By participating in the Contest, entrant agrees to be bound by these Official Rules, including all eligibility requirements and all decisions of TRICITYLOCAL.COM, which are final and binding in all matters relating to the Contest. TRICITYLOCAL.COM AND ITS PARENT COMPANY, BAY IMAGING AND TECHNOLOGY SERVICES, LLC  AND ITS CONTEST SPONSOR are not responsible for (a) lost, late, incomplete, illegible, mutilated, damaged, garbled, or misdirected entries; (b) telephone, computer, or network malfunction or error; (c) communication disruption or other disruptions related to Internet traffic, virus, bug, worm, or non-authorized intervention; or (d) damage caused by a computer virus or otherwise resulting to any computer from entrant's access of the Contest website. In the event the Contest is compromised in any way, TRICITYLOCAL.COM AND ITS PARENT COMPANY, BAY IMAGING AND TECHNOLOGY SERVICES, LLC  AND ITS CONTEST SPONSOR reserve the right to cancel the Contest and to determine the winners from all eligible entries received as of the termination date.

Persons found tampering with or abusing any aspect of the Contest, or whom TRICITYLOCAL.COM/Sponsor believes to be causing any malfunction, error, disruption, or damage will be disqualified. TRICITYLOCAL.COM AND ITS PARENT COMPANY, BAY IMAGING AND TECHNOLOGY SERVICES, LLC  AND ITS CONTEST SPONSOR reserves the right to disqualify any unauthorized entries. Entering the Contest constitutes permission to use the winning photograph, name, voice, photo, and likeness of the winner(s) for advertising and publicity purposes of TRICITYLOCAL.COM and/or the Contest, without further compensation.

RELEASE OF LIABILITY By participating in the Contest, entrant agrees to hold TRICITYLOCAL.COM AND ITS PARENT COMPANY, BAY IMAGING AND TECHNOLOGY SERVICES, LLC  AND/OR ITS SPONSOR and their officers, directors, employees, agents, affiliates, subsidiaries, and parents harmless from any and all liability, claims, or actions of any kind, including, without limitation, property damage, personal injury, and/or death, arising out of his or her participation in the Contest, and acceptance and/or use or misuse of the prizes in connection with the Contest. In addition, entrant agrees that the above-mentioned entities are in no manner responsible for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to the Contest and/or the prize.
